OBJECT OF THE ON-LINE CONTRACT AND ITS DEFINITION
SALE PRICES AND PURCHASE
All sale prices of products as displayed and indicated on the Internet site www.tibiona.it, which constitute an offer to the public pursuant to art. 1336 cc, they are inclusive of VAT (4%, 10%, 22%, depending on the type of product); shipping and associated costs are duly highlighted on the "Terms of sale" page within the site, that the client must take care to see before confirming their purchase; in case of abroad delivery any additional costs due to taxes or fees provided by law in the State of destination will be charged to the consumer. The purchase contract is concluded through exact compilation and consensus as expressed by "on-line" confirmation. On this site, the minimum cost cap is 18 € VAT, transport and fees excluded. The customer can pay the ordered goods using any accepted method of payment as listed on-line at the time of purchase.
LIABILITY AND CLAIMS
Tibiona assumes no responsibility for problems due to force majeure such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other events that could completely or partially prevent, in whole or in part, to meet the deadlines agreed by the contract. Tibiona will not be liable to any party for any damages, losses and costs incurred as a result of failure in fulfilling the contract for the forementioned reasons. Likewise Tibiona is not responsible for any fraudulent or illegal use that may be made of checks and other means of payment by third parties. For any complaints please use the form below.
The consumer agrees and undertakes, once the purchase procedure "on line", to handle the printing and keep the present general conditions, which, in any case, they have already seen and accepted as a necessary step in the acquisition and the specifications of the product, and in order to fully satisfy the conditions laid down in art. 3:04 DECR. Legislative. No 185/1999. It is strictly prohibited to enter false and/or invented and/or fantasy data, within the registration process required to provide the client with the correct procedure for the execution of this contract and the subsequent communications; personal data and e-mail must be the client's own real personal data and neither third parties' or invented. It is expressly forbidden to make double entries for a single person or enter data of third parties. Tibiona reserves the right to prosecute any violation or abuse, in behalf and for the protection of all consumers.
RIGHT OF WITHDRAWAL - RETURNS AND REFUNDS
Purchases made on the tibiona.it website are governed by Italian law on correspondance sales order.
With reference to the D. Lgsl. 206/2005, the consumer who for whatever reason is not satisfied with the purchase made, has the right to withdraw from the contract stipulated within the term of 14 days, for the goods from the day of their receipt. The withdrawal must be manifested by simply sending an email to email@example.com
The return of the articles will be accepted, provided they are in the same condition as the new one.
ATTENTION: the right of withdrawal is not provided, as indicated by the law, for food products or domestic products delivered on a regular basis.
The consumer can not exercise this right of withdrawal for contracts for the purchase of products which, by their nature, can not be returned or are liable to deteriorate or expire rapidly; in the same way products intended for food preparation can not be returned if they have been used. Within the aforementioned term of 14 days, all purchased goods, possibly intact and in their original packaging, including any manuals, must be returned to the sender-supplier. If the product had been used or the packaging, manuals or other material related to the product, shows signs of wear (dirt, lines, stains, deformations, breakages or other), the refund will be made partially (the reimbursement measure will be agreed once that the product will have reached the Tibiona site and will have been inspected).

How to return the goods?
You can use the same box in which you received the goods or any box suitable for the size of the product(s) to be returned.
If the product is fragile and may be damaged during transport, please insert it in the package newspaper or other protective material.
Please include in the package a copy of the receipt or invoice that you received with the order.
If necessary, include the bank details for the reimbursement of the current account, if the payment was made by cash on delivery or by bank transfer.
Please also seal the box so that the package is suitable for transport with the courier.
How does the refund work?
The refund will be made within 10 working days of receipt of the returned package.
The repayment terms are as follows:
- If the order has been paid by Paypal, it is possible to credit the amount to the Paypal account;
- If the order has been paid in cash or by credit card, it is possible to request the credit of the amount in the bank account by bank transfer.
- Or you can request a refund in the form of a coupon to be used on tibiona.it
Tibiona will send the entire amount paid by the consumer within fourteen days from the date of shipment of the goods by the customer, subject to any costs of restoration for damage to the goods and the costs incurred for the return of the goods. In the event that the returned product has been damaged during transport, we will notify the customer of the event within the working day following the receipt at our office, to allow the same to file a complaint against the courier chosen for shipping. In this case, the product will be returned to the customer at his own expense and at the same time the request for withdrawal will be canceled. For this reason it is strongly recommended to make an insured shipment. Upon arrival in our warehouses, all returned products will be carefully examined in order to verify any damage or tampering not caused by transport.
The transport costs reimbursed are only those for the forwarding of the product from our office and not those for the return, at the same time if a faster courier is chosen (Bartolini or Gls), compared to the standard one (Bartolini), the amount of the reimbursement will be that of the cheapest courier, therefore Bartolini.

Tibiona has the right to terminate the contract by simply informing the customer with adequate and justified reasons; in this case the customer shall only be entitled to a refund of the amount they already paid. The obligations assumed by the customer referred to 'art. 9 (Obligations), as well as security for completion of payment the customer makes through means defined in art. 2, are essential, so that by express agreement, non-fulfillment of one of these obligations by the customer, will lead to termination of the contract under article 1456 of the Civil Code entitled without any judicial decision, except for to the right for Tibiona to sue for additional damages. The customer is entitled to cancel the contract within 24 hours of receipt of the confirmation email after promptly informing the customer service via e-mail to: email@example.com
Any dispute regarding the application, execution, interpretation and violation of purchase contracts stipulated "on-line" through www.tibiona.it website are subject to Italian jurisdiction; these general conditions are reported, although not expressly referred to therein, in conjunction with the Legislative Decree No 50 of 15.1.1992 and Legislative Decree No 185 of 22.5.1999.
For any problem related accessories sold on the site: mills, sprouters, dryers and the like, warranty is handled by Tibiona, which will act against the supplier while keeping customer up-to-date regarding the current state of the procedure.
